Section 01

Purpose and scope

These terms of sale govern the sale of plants, pots, accessories and related services offered by [Company name] on the site available at [site address].

Placing an order implies unreserved acceptance of these terms in the version in force on the day of the order. They apply to consumer customers; professional orders may be subject to specific terms.

Section 03

Products and availability

The products offered are living plants, containers and accessories. Photographs, heights and descriptions are indicative: every specimen is unique and may show natural variations in habit, shade, branching and size.

Offers are valid while stocks last. The availability shown on the site is indicative and may change between the order and its preparation; where a product is unavailable, the customer is informed and may choose an equivalent specimen, a credit or a refund of the relevant part.

Section 04

Prices

Prices are shown in Moroccan dirhams (DH), all taxes included, excluding delivery. Delivery fees are calculated from the destination city and the size class of the plants, and displayed before the order is confirmed.

Prices shown for professional accounts may be expressed excluding tax, under the terms specific to those accounts. [Company name] may change its prices at any time; products are invoiced at the rates in force when the order is recorded.

Section 05

Orders

The customer selects the products, configures size and presentation where relevant, enters their contact and delivery details, then confirms the order.

Creating an account is not required: guest checkout is available.

Section 06

Payment

Card payments are handled by an approved payment provider; [Company name] has no access to the customer's banking data. Goods remain the property of the seller until full payment of the price.

Section 07

Delivery

Deliveries are made to the served cities listed on the site. Fees and lead times depend on the city and the size class of the plants; they are shown before the order is confirmed and detailed on the Delivery page.

Stated lead times are estimates expressed in business days and are not a firm commitment. A slot is confirmed with the customer before delivery. Oversized specimens are delivered under a special delivery quote.

The customer ensures the delivery location is accessible and reports any particular constraint when ordering.

Section 08

Withdrawal, returns and claims

In accordance with the Moroccan regulations applicable to distance selling, the customer has a right of withdrawal under the conditions and time limits set by law: [legal time limit to confirm with counsel].

Living plants are perishable goods: certain exclusions may apply. The recommended procedure for reporting a plant received damaged, the cases not taken back and the handling of requests are described on the Returns & claims page.

Section 09

Guarantees

The legal guarantees applicable to the sale remain available to the customer under the conditions set by the regulations in force.

The quality approach applied to plants before shipping — selection, acclimation, checks — is described on the Quality commitment page. A commercial guarantee on plant establishment, its duration and its scope remain to be defined: [commercial guarantee to confirm].

Section 10

Liability

[Company name] cannot be held liable for damage resulting from installation, care or use that does not match the plant's needs, nor for the consequences of exceptional weather events.

The site may contain links to third-party sites whose content does not bind the seller. In the event of force majeure, performance of the obligations is suspended.

Personal data

The data collected when ordering is necessary to process it. It is processed in accordance with Law No. 09-08 on the protection of individuals with regard to the processing of personal data, and with the formalities filed with the National Commission for the Control of Personal Data Protection (CNDP): [CNDP filing number].

Intellectual property
